Personal Data We Collect

In connection with your application process we collect the following “Personal Data”: your name, email address, phone number, home address, prior employment history, education history, and other information that is capable of identifying you personally.

Personal Data Processing and Sharing

We process your Personal Data based on our legitimate interests, to provide services requested by you, and to comply with legal requirements. We process your Personal Data as necessary for us to evaluate your employment application and to provide you with services necessary to onboard you as an employee, should you receive a job offer from Company.

We will retain your Personal Data for (i) up to six months following the completion of the application process, if your application is unsuccessful or (ii) so long as necessary to employ you and provide you with services related to your employment and as required by applicable law, if the application process results in your employment at the Company.

We will transfer your Personal Data to the United States and take reasonable and appropriate security measures, including implementing standard contractual clauses, to provide for the safe transfer and storage of your Personal Data.

We will disclose your Personal Data to Company’s parent, subsidiary, and affiliated companies for the purposes listed above. We will disclose your Personal Data to our service providers and contractors who assist us with providing services necessary for the purposes listed above. We will also disclose your Personal Data to government or law enforcement officials or private parties if it is necessary in order to comply with law or to respond to legal requests (including court orders and subpoenas).

Your Rights

With respect to your Personal Data, you have the right to:

request access to and be provided with information on the processing of your Personal Data;
request corrections of your Personal Data if such Personal Data proves inaccurate or incomplete;
request your personal data to be deleted (i) if it is no longer necessary for the purposes described in this Notice, (ii) where applicable, should you decide to withdraw your consent where you gave it, (iii) where applicable, should you object to its processing for direct marketing purposes, (iv) should you identify that it would have been unlawfully processed, (v) should we be under a legal obligation to erase it to comply with EU law or the law of an EU country and always provided that we are not under a legal obligation to keep it;
restrict the processing of your personal data (i) if you contest its accuracy; (ii) if the processing is unlawful and you oppose the erasure; (iii) if it is no longer needed for the purposes set out in this Notice, but you require it for the establishment, exercise, or defense of a legal claim, (iv) where applicable, if you object to profiling;
object to the processing of your Personal Data for direct marketing purposes or to any processing which we would have grounded on our legitimate interest (e.g. profiling); and
receive Personal Data which you provided to us in a structured, commonly used and machine-readable format and to transmit those to another provider provided these are processed based on your consent or our contract.

La presente informativa ("informativa") è stata redatta allo scopo di informarvi in merito ai dati personali che raccogliamo e trattiamo in relazione alla vostra candidatura a Williams-Sonoma, Inc. UK Limited (l’"azienda").

Dati personali raccolti

In relazione alla vostra candidatura e nel fornirvi servizi a esso inerenti o da voi richiesti, raccogliamo i seguenti "dati personali": nome, data di nascita, numero di previdenza sociale, codice del dipendente, sesso, stato civile, indirizzo e-mail, numero di telefono, domicilio, passaporto, visto o altra documentazione relativa al permesso di lavoro, coordinate bancarie, trascorsi lavorativi, formazione e altre informazioni che vi identificano personalmente. È possibile che vengano da noi raccolte anche informazioni riguardanti il vostro stato di salute.

Trattamento e condivisione dei dati personali

Trattiamo i dati personali sulla base di nostri legittimi interessi, per valutare la vostra candidatura e per soddisfare i requisiti legali. Trattiamo i dati personali necessari ai fini della vostra candidatura, per adempiere ai nostri obblighi di datori di lavoro, per la sicurezza dell’azienda e dei dati, per prevenirne la perdita e per offrirvi i servizi necessari al vostro impiego o che voi stessi richiedete all’azienda.

Conserveremo i dati personali necessari per: (i) non più di sei mesi dopo la conclusione della vostra candidatura se la vostra candidatura viene respinta; o (ii) per il tempo necessario per assumervi e per fornirvi servizi ad esso relativi secondo quanto richiesto dalla legge applicabile, se la vostra candidatura viene accettata.

Trasferiremo i vostri dati personali negli Stati Uniti e adotteremo ragionevoli e appropriate misure di sicurezza, tra cui l’attuazione di clausole contrattuali standardizzate al fine di garantire la sicurezza del trasferimento e della conservazione dei dati.

Divulgheremo i vostri dati personali alla società madre, a controllate e affiliate, per le finalità di cui sopra. Divulgheremo i vostri dati personali ai nostri fornitori e appaltatori che ci assistono nella fornitura dei servizi necessari per le finalità sopra elencate. Divulgheremo i vostri dati personali anche a funzionari governativi o di polizia, o a terze parti private, qualora fosse necessario per legge o per dare seguito a richieste legali (compresi ordini del tribunale e mandati di comparizione).

I vostri diritti

Per quanto riguarda i vostri dati personali, avete il diritto di:

richiederne l'accesso e ricevere informazioni in merito al loro trattamento;
richiedere rettifiche dei vostri dati personali nel caso in cui si dimostrassero inesatti o incompleti;
richiedere la cancellazione dei vostri dati personali (i) qualora non fossero più necessari per le finalità descritte nella presente informativa, (ii) dove applicabile, nel caso in cui decidiate di revocare il consenso al loro trattamento, (iii) dove applicabile, nel caso in cui vi opponeste al loro trattamento per finalità di marketing diretto, (iv) nel caso in cui verificaste che sono stati trattati in modo illecito, (v) nel caso in cui avessimo l’obbligo giuridico di cancellarli per conformarci al diritto dell'Unione Europea o alla legge di un paese dell'UE, e sempre ammesso che non sussistano per noi obblighi giuridici di conservarli;
limitare il trattamento dei vostri dati personali (i) se ne contestaste l'esattezza; (ii) se il trattamento fosse illecito e vi opponeste alla loro cancellazione; (iii) qualora non fossero più necessari per le finalità indicate nella presente informativa, seppur a voi necessari per la messa in atto, l’esercizio o la difesa di una rivendicazione legale, (iv) dove applicabile, nel caso in cui vi opponeste alla profilazione;

Aviso de processamento de dados pessoais dos candidatos a emprego

O presente aviso (a seguir designado como “Aviso”) serve para o(a) informar a respeito dos dados pessoais que recolhemos e processamos em associação com o seu pedido de emprego na Williams-Sonama Inc., UK Limited (a seguir designada como “Empresa”).

Dados pessoais que recolhemos

Associado ao facto que consideraremos seu pedido de emprego, recolhemos os seguintes “Dados Pessoais”: o seu nome, endereço eletrónico, número de telefone, morada de casa, histórico de empregos anteriores, histórico de escolaridade e outras informações que possam identificá-lo(a) pessoalmente.

Processamento e partilha de Dados Pessoais

Processamos os seus Dados Pessoais com base nos nossos interesses legítimos, para provir serviços solicitados por você, a para cumprir com requisitos legais. Processamos os seus Dados Pessoais conforme necessário para considerear a seu pedido de emprego, e fornecer os serviços necessários para integrar você como funcionário, caso receba uma oferta de emprego da Empresa.

Reteremos os seus Dados Pessoais por (i) até seis meses após a conclusão do processo de inscrição, se seu pedido de emprego não for bem-sucedida ou (ii) pelo tempo necessário para empregá-lo e fornecer serviços relacionados ao seu emprego e conforme necessário pela lei aplicável, se o processo de inscrição resultar em seu emprego na Empresa.

Transferiremos os seus Dados Pessoais para os Estados Unidos e tomaremos medidas de segurança razoáveis e adequadas, incluindo a implementação de cláusulas contratuais padrões, para providenciar a transferência e o armazenamento seguros dos seus Dados Pessoais.

Divulgaremos os seus Dados Pessoais à empresa-mãe e às empresas filiais e afiliadas da Empresa para os fins supracitados. Divulgaremos os seus Dados Pessoais aos nossos prestadores de serviços e contratantes que nos ajudam a fornecer os serviços necessários para os fins supracitados. Divulgaremos igualmente os seus Dados Pessoais a funcionários governamentais ou forças policiais ou a entidades privadas, se tal for necessário para o cumprimento da lei ou responder a exigências legais (incluindo decisões judiciais e citações).

Os seus direitos

Em relação aos seus Dados Pessoais, tem o direito de:

Solicitar o acesso e informações sobre o processamento dos seus Dados Pessoais;
Solicitar correções dos seus Dados Pessoais se os mesmos estiverem incorretos ou incompletos;
Solicitar a eliminação dos seus Dados Pessoais (i) se já não forem necessários para os fins descritos no presente Aviso, (ii) quando aplicável, caso decida retirar a sua autorização se a tiver dado, (iii) quando aplicável, caso se oponha ao respetivo processamento para fins de marketing direto, (iv) se detetar que os mesmos foram processados ilegitimamente, (v) se estivermos sujeitos a uma obrigação legal de os apagarmos para cumprir a legislação da União Europeia ou a legislação de um Estado-membro da União Europeia e sempre que não estejamos sujeitos a uma obrigação legal de os mantermos;
Restringir o processamento dos seus Dados Pessoais (i) se contestar a exatidão dos mesmos; (ii) se o processamento for ilegítimo e se opuser à eliminação; (iii) se já não forem necessários para os fins referidos no presente Aviso, mas necessitar do dito processamento para estabelecer, exercer ou defender uma reivindicação legal, (iv) quando aplicável, na eventualidade de se opor à elaboração do seu perfil;
Opor-se ao processamento dos seus Dados Pessoais para fins de marketing direto ou a qualquer processamento que tenhamos fundado nos nossos interesses legítimos (por exemplo, elaboração de perfil); e
Receber Dados Pessoais que nos tenha fornecido num formato estruturado, utilizado vulgarmente e legível por máquina e transmitir os mesmos a outro fornecedor, desde que estes sejam processados com base na autorização dada por si ou no nosso contrato.

TURKEY (DPL) APPLICANT NOTICE FOR PROCESSING OF PERSONAL DATA

We thank you for your application to Williams-Sonoma Italy R.S.L (“Williams-Sonoma”) and for your desire to work with us. As Williams-Sonoma, we need to process the personal data of you as an Employee or Intern Candidate as subject to below-given considerations, mainly for the assessment of your application. As a Data Controller, we would like to inform you in detail with regard to the processing and transfer of your personal data within the scope of the Law No. 6698 on Protection of the Personal Data (“Law No. 6698”).

What Type of Personal Data is Processed by Us?

Within the scope of this notice, “personal data” refers to all of your personal data which you have submitted to us with your CV/resume and/or all of your personal data which you may share during the employment interview (in case our company decide to make an interview with you with respect to your application), including but not limited to your name-surname, online user name, photograph, gender, date and place of birth, contact details such as your address, phone number and e-mail address, your educational background, business experience and competencies (all shall be hereinafter referred to as the “Personal Data”) as well as your sensitive personal data such as statement of health including your association membership or health data (all shall be hereinafter referred to as “Sensitive Personal Data”) if they are mentioned in your CV/Resume or shared with us during the employment interview (in case our company decide to make an interview with you with respect to your application).

For What Purposes and on Which Legal Grounds Do We Process Your Personal Data?

Your Personal Data will be processed pursuant to Article 5/2(c) of the Law No. 6698 and for the purposes set forth herein below since it is related directly to execution of an employment agreement or provision of internship opportunity if your recruitment process is completed successfully:

Assessing your job/internship application and conducting the relevant human resources process,
Following up recruitment / internship applications,
If your application is deemed appropriate, sufficient and satisfactory by Williams-Sonoma for any open position, contacting you for recruitment and employment or acceptance of internship application and to take the necessary actions accordingly.

Apart from the purposes stated above, your personal data may also be processed even if your application is rejected on the grounds that such processing is obligatory for establishment, use or protection of a right and that Williams-Sonoma has legitimate interests pursuant to sub-paragraphs (e) and (f) of Article 5/2 of the Law No. 6698 for the purposes of storing your personal data by Williams-Sonoma for future consideration in order to assess your eligibility for potential job opportunities and to contact & inform you about relevant opportunities. Should your application be rejected, you may at any time convey your request if you do not want your personal data to be stored and processed in this context. In this case, your data related to the job/(internship application shall be immediately deleted, destroyed or anonymized.

Provisions of Article 5/2 (c), (e) and (f) of the Law No. 6698 constitute the legal grounds for collection and processing of your personal data and therefore, your explicit consent is not required for the processing your data within the scope of these purposes.

Williams-Sonoma does not ask you to share Sensitive Personal Data within the scope of job and internship applications. However, if any Sensitive Personal Data is included in your CV/Resume and you wish the subject matter data to be taken into consideration during assessment process, or you provide us with information on health disability, we need your explicit consent in accordance with Article 6 of the Law No. 6698. For this purpose, you may copy the exemplary declaration of consent and send it to us in response to this e-mail. Exemplary declaration of consent is provided solely as an example and you are free to amend its scope and content as you wish. If you do not give explicit consent to Williams-Sonoma for processing of your sensitive personal data within the scope of your application; relevant data shall not be taken into consideration during assessment of your application and they shall be erased from your CV/Resume. Nevertheless, other personal data apart from your Sensitive Personal Data and that are included in your CV/Resume (if deemed appropriate) may be processed within the aforementioned scope.

To Whom and For What Purposes May We Disclose Your Personal Data?

Your personal data shared with Williams-Sonoma hereunder may be disclosed to our subsidiary and affiliated companies and liaison offices, our third party business partners residing in Turkey as well as third party companies from which we receive services/support/consultancy including our lawyers, independent accountants, auditors, our suppliers and government or law enforcement officials within the scope of the purposes stated above.

Your personal data may also be shared with our parent company based in United States. In any case, Williams-Sonoma takes reasonable and appropriate security measures, including implementing standard contractual clauses, to provide for the safe transfer and storage of your Personal Data.

For How Long Do We Retain Your Personal Data?

We will retain your Personal Data for (i) up to 3 years following the completion of the application process, if your application is unsuccessful or (ii) so long as necessary to employ you and provide you with services related to your employment and as required by applicable law, if the application process results in your employment at the Company.

Which Methods Do We Employ for Collection of Your Personal Data?

Your personal data may be collected through your e-mails sent to our company’s official HR e-mail address and (if applicable) through job/internship applications in writing or electronically or orally for the purposes and on the legal grounds listed in this form.

What Are Your Rights Concerning Your Personal Data?

We would like to remind that you have the following rights under the Law No. 6698, Article 11:

To learn whether your personal data is processed or not, and to request information about processing thereof;
To learn the purpose of processing your personal data and whether relevant data is used in accordance with the intended purpose;
To know the third parties to whom your personal data is transferred;
To request correction in cases where your personal data is processed erroneously or deficiently, and when you enforce this right, to request the notification of the correction to third parties to whom your personal data is transferred;
To request for the destruction or deletion of your personal data, in the event the purposes for processing your personal data cease to exist and when you enforce this right, to request notification of this to third parties to whom your personal data is transferred;
To object to the outcome of the analysis of the collected information made by automatic systems and to claim for damages in case you suffer any loss from the analysis of the collected information which is made by automatic systems (if applicable).

Temelde, başvurunuzun değerlendirilmesi amacı ile olmak üzere, Williams-Sonoma olarak aşağıda belirtilen hususlara tabi olarak, Çalışan veya Stajyer Adayı sıfatıyla tarafınıza ait kişisel verileri işleme ihtiyacı duymaktayız. Veri Sorumlusu olarak sizi 6698 sayılı Kişisel Verilerin Korunması Kanunu (“KVKK”) kapsamında kişisel verilerinizin işlenmesi ve aktarılması konusunda detaylı olarak bilgilendirmek isteriz.

Ne Tür Kişisel Verilerinizi İşliyoruz?

Bu Aydınlatma Metni kapsamında “kişisel veriler”; adınız-soyadınız, çevrimiçi kullanıcı adınız, fotoğrafınız, cinsiyetiniz, doğum tarihiniz ve doğum yeriniz, adresiniz, telefon numaranız ve e-posta adresiniz gibi iletişim bilgileriniz, eğitim durumunuz, iş deneyiminiz ve yetkinlikleriniz dâhil ancak bunlarla sınırlı olmamak üzere özgeçmişiniz ile bize ilettiğiniz ve/veya mülakat sırasında verebileceğiniz her türlü kişisel verileriniz (bundan sonra “Kişisel Veriler” olarak anılacaktır) ve özgeçmişinizde belirtmişseniz veya mülakat sırasında bizimle paylaşmışsanız (başvurunuza istinaden şirketimizin sizinle mülakat gerçekleştirmeye karar vermesi durumunda) üyesi bulunduğunuz dernekler veya sağlık verileri dâhil sağlık raporunuz gibi size ait özel nitelikli kişisel verileriniz (tamamı bundan böyle “Özel Nitelikli Kişisel Veriler” olarak anılacaktır) dâhil ancak bunlarla sınırlı olmaksızın özgeçmişiniz ile tarafımıza ilettiğiniz kişisel verilerinizin tamamı ve/veya mülakat sırasında (başvurunuza istinaden şirketimizin sizinle mülakat gerçekleştirmeye karar vermesi durumunda) bizimle paylaşabileceğiniz tüm kişisel verileriniz anlamına gelmektedir.

Kişisel Verilerinizi Hangi Amaçlarla ve Hukuki Sebeplerle İşliyoruz?

Kişisel Verileriniz, işe alım sürecinizin olumlu sonuçlanması halinde iş sözleşmesinin kurulması ya da staj imkânının sağlanması ile doğrudan ilgili olduğundan KVKK’nın Madde 5/2 (c) hükmü uyarınca, aşağıda belirtilen amaçlarla işlenecektir:

Yapmış olduğunuz iş/staj başvurusunu değerlendirmek ve ilgili insan kaynakları süreçlerini gerçekleştirmek,
İşe alım / staja kabul başvurularının takibini sağlamak,
Başvurunuzun Williams-Sonoma tarafından açık herhangi bir pozisyon için uygun, yeterli ve tatmin edici bulunması halinde, sizinle işe alma ve istihdam ya da staja kabul amacı ile iletişime geçmek, bu kapsamda gerekli işlemleri yapmak.

Yukarıdaki belirtilen amaçların dışında, kişisel verileriniz, bir hakkın tesisi, kullanılması veya korunması için zorunlu olduğu ve Williams-Sonoma’nın meşru menfaati olduğu gerekçesiyle KVKK’nın Madde 5/2 (e) ve (f) hükmü uyarınca başvurunuzun olumsuz sonuçlanması halinde, kişisel verilerinizi Williams-Sonoma tarafından potansiyel iş fırsatları için gelecekte uygunluğunuzu değerlendirmek ve bu doğrultuda sizinle iletişime geçerek söz konusu fırsatlar hakkında tarafınıza bilgi vermek amacıyla da işlenebilir. Başvurunuzun kabul edilmemesi halinde kişisel verilerinizin bu kapsamda saklanmasını ve işlenmesini istemezseniz, talebinizi her zaman iletebilirsiniz. Bu durumda, iş/staj başvurusuna ilişkin verileriniz, en kısa süre içerisinde silinecek, yok edilecek ya da anonim hale getirilecektir.

Kişisel verilerinizin, yukarıda belirtilen amaçlar kapsamında toplanmasının ve işlenmesinin hukuki sebebi, KVKK’nın Madde 5/2 (c), (e) ve (f) hükümleri olup bu nedenle, bu amaçlar kapsamında verinizin işlenmesi için açık rızanıza ihtiyaç bulunmamaktadır.

Williams-Sonoma, iş ve staj başvurularına ilişkin Özel Nitelikli Kişisel Verileri paylaşmanızı istememektedir. Ancak özgeçmişinizde herhangi bir Özel Nitelikli Kişisel Veri var ise ve bu verilerin de değerlendirme sürecinde dikkate alınmasını istiyorsanız veya bize engellilik durumuna ilişkin bilgiler iletmişseniz KVKK’nın Madde 6 hükmü uyarınca açık rızanıza ihtiyaç duyuyoruz. Bu amaçla, aşağıda örnek olarak hazırladığımız rıza metnini kopyalayarak tarafımıza e-posta yolu ile bu e-postaya cevaben iletebilirsiniz. Örnek rıza metni, yalnızca örnek olarak hazırlanmış olup kapsam ve içeriğini dilediğiniz şekilde değiştirebilirsiniz. Williams-Sonoma’ya başvurunuz kapsamında özel nitelikli kişisel verilerinizin işlenmesine ilişkin açık rıza vermemeniz halinde, bu veriler, başvurunuzun değerlendirilmesi sırasında dikkate alınmayacaktır ve özgeçmişinizden silinecektir. Ancak Özel Nitelikli Kişisel Verileriniz dışında, özgeçmişinizde yer alan (uygun görülmesi halinde) diğer kişisel veriler, yukarıda belirtilen kapsamda işlenebilecektir.

Kişisel Verilerinizi Kimlere ve Hangi Amaçlarla Aktarabiliriz?

Williams-Sonoma ile bu kapsamda paylaşmış olduğunuz kişisel verileriniz, yukarıda belirtilen amaçlar çerçevesinde, iştiraklerimiz ve bağlı şirketlerimiz, irtibat bürolarımız, Türkiye’de yerleşik bulunan üçüncü kişi iş ortaklarımız ve avukatlarımız, mali müşavirler, denetçiler, tedarikçilerimiz ve hükümet veya emniyet yetkilileri dâhil olmak üzere hizmet/destek/danışmanlık aldığımız üçüncü kişi firmalar ile paylaşılabilecektir.

Kişisel verileriniz ayrıca Amerika Birleşik Devletleri’nde yerleşik bulunan ana şirketimiz ile de paylaşılabilir. Kişisel Verilerinizi Ne Kadar Süreyle Saklamaktayız?

Kişisel Verilerinizi, (i) başvurunuzun kabul edilmemesi halinde başvuru sürecinin sona ermesi itibariyle 3 yıla kadar veya (i) başvuru sürecinin Şirketimizde işe alınmanız ile sonuçlanması halinde, sizi işe almak ve işe alımınızla ilgili hizmetler sunmak için gerektiği kadar süreyle veya yürürlükteki kanunlar uyarınca gerekli görüldüğü süreyle saklayacağız.

Kişisel Verilerinizi Hangi Yöntemlerle Topluyoruz?

Kişisel verileriniz şirketimizin kurumsal İK e-posta adresine veya (geçerli ise) yazılı olarak veya elektronik ortamda veya sözlü olarak iletilen iş/staj başvuruları üzerinden, işbu formda sayılan amaç ve hukuki sebeplerle toplanabilir.

Kişisel Verilerinize İlişkin Haklarınız Nelerdir?

Hatırlatmak isteriz ki KVKK Madde 11 uyarınca aşağıda belirtilen haklara sahipsiniz:

Kişisel verilerinizin işlenip işlenmediğini öğrenme, işlenmesine ilişkin bilgi talep etmek;
Kişisel verilerinizin işlenme amacını ve bunların amacına uygun kullanılıp kullanılmadığını öğrenmek;

Kişisel verilerinizin eksik veya yanlış işlenmiş olması hâlinde bunların düzeltilmesini talep etmek, bu hakkınızı kullanmanız halinde bu durumun kişisel verilerinizin aktarıldığı üçüncü kişilere de bildirilmesini talep etmek;
Kişisel verilerinizin işlenme nedenlerinin ortadan kalkması halinde kişisel verilerinizin silinmesini veya yok edilmesini istemek, bu hakkınızı kullanmanız halinde bu durumun kişisel verilerinizin aktarıldığı üçüncü kişilere de bildirilmesini talep etmek;
Elde ettiğimiz bilgilerin otomatik sistemler ile analizi yoluyla hakkınızda ortaya çıkan sonuca itiraz etmek ve toplanan bilgilerin otomatik sistemler tarafından (var ise) gerçekleştirilen analizi sonucunda herhangi bir zarara uğramanız halinde tazminat talep etmek.
